U.S. District Court Judge Donald Voorhees rules suppression of evidence by the War Department was a fundamental error and vacates Gordon Hirayabashi's exclusion order conviction.

The Hirayabashi case was heard in Seattle, where Judge Voorhees ruled that the government suppressed evidence, thereby weakening Hirayabashi's ability to mount an adequate defense. The judge vacated the violation of evacuation but not the violation of curfew. An appellate court reversed the decision not to vacate the curfew violation. Judge Voorhees complied and vacated the curfew violation as well, in January 1988.
